A mother was yesterday charged with murder after she allegedly gave her four-year-old daughter a fatal dose of methadone, just months after the NSW Department of Community Services learned the child had suffered a cardiac arrest after a similar incident but failed to act.

Margaret Jalaty, a 32-year-old unemployed woman from Revesby in Sydney's southwest, appeared in Burwood Local Court yesterday afternoon after being arrested by Bankstown detectives earlier in the day. She was refused bail.

Ms Jalaty allegedly administered the lethal dose to her daughter, Alia Maarbani, in November 2003, the court was told. In a statement of facts tendered to the court, police alleged she drugged her child to allow her to have sex with a lover in peace.

The statement also alleged "the deceased child had been presented in a critical condition to the Sydney Children's Hospital on a previous occasion in August 2003 with methadone poisoning after having suffered a cardiac arrest".

"This incident was investigated by DOCS who failed to notify the police," the statement said, adding that DOCS had been told at the time the methadone dose had been accidentally ingested by the child.

A DOCS spokeswoman last night confirmed the department had been working with Ms Jalaty and her daughter since 1999.

The statement of facts claimed that on November 22 last year Ms Jalaty went to Bankstown McDonald's to meet "a male acquaintance she had previously corresponded with on a chat line".

"The accused escorted the male to her home where she intended to entertain him but couldn't as the victim would not go to sleep. After several hours of attempting to put the victim to sleep, the victim was taken to her room where she slept," it said.

Ms Jalaty will next appear on January 19 in Burwood Local Court for a mention via videolink.

The case comes as the six-year-old girl at the centre of another incident involving DOCS was removed from the care of her mother to be placed in a foster home.

The young girl's plight grabbed national attention last week after a NSW Ombudsman's report raised concerns about the way DOCS had responded to the case involving the girl and her brother, 3.

Police and coronial investigations are under way into the death of the boy who was left with his sister in the care of two men known to police as sex offenders.

Two days before the boy's death in September 2003, one of the men videotaped himself raping the girl. The man, William Thomas Clare, was sentenced in October to 16 years' jail for the crime.
